Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and MapTurtle, LLC (“MapTurtle,” “we,” “us,” or “our”) governing your access to and use of the MapTurtle website, mobile applications, APIs, and all related services (collectively, the “Platform”).
By accessing or using the Platform in any manner — including browsing, creating an account, submitting content, or sharing trips — you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
If you do not agree to these Terms, you must immediately discontinue all use of the Platform.
If you are using the Platform on behalf of a business or other legal entity, you represent that you have authority to bind that entity to these Terms, and references to “you” include that entity.
Description of Services
MapTurtle is an aviation discovery and storytelling platform that helps pilots and aviation enthusiasts explore airports, fixed base operators (FBOs), local attractions, and curated flight experiences. The Platform includes features such as:
- Curated airport and FBO directories with editorial content
- Aviation “Experiences” — narrative, route-based flight adventures
- Trip planning and sharing tools, including shareable trip links and QR codes
- An aviation events directory including fly-ins, safety seminars, and club meetings
- User accounts, profiles, and community features
MapTurtle reserves the right to modify, suspend, or discontinue any portion of the Platform at any time, with or without notice. We shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
Aviation Data Disclaimer
MapTurtle is an informational and editorial platform. It is not a certified aeronautical information service, flight planning tool, weather service, or safety-of-flight resource. No data on the Platform should be used to make any aviation safety decision.
3.1 — Not for Navigation or Flight Planning
All airport information, FBO data, runway data, fuel pricing, frequencies, hours of operation, services, and related content presented on the Platform are provided solely for recreational discovery and general informational purposes. This information:
- May be incomplete, outdated, or inaccurate
- Is not verified against official aeronautical databases on a real-time basis
- Is not a substitute for official FAA publications, Airport/Facility Directories, NOTAMs, METARs, TAFs, or other certified sources
- Should never be used as the sole basis for any preflight planning, fuel stop decisions, or in-flight navigation
3.2 — Pilot in Command Responsibility
The Pilot in Command (PIC) bears sole legal and operational responsibility for all preflight planning, in-flight decisions, and the safe outcome of every flight. You expressly acknowledge that MapTurtle data does not relieve you of this responsibility in any way and that you will independently verify all operationally relevant information through authoritative, certified sources before flight.
3.3 — FBO and Airport Service Data
FBO availability, services, fuel types, pricing, hours, and contact information are gathered from publicly available sources and are subject to change without notice. MapTurtle makes no warranty that any FBO listed on the Platform will be open, available, or able to provide the services listed at the time of your visit. Always contact FBOs directly to confirm current services before departing.
3.4 — Events Information
Aviation events listed on the Platform are submitted by event coordinators or gathered from public sources. MapTurtle does not independently verify event safety protocols, insurance, airspace authorizations, or regulatory compliance. Attendance at any event listed on the Platform is at your sole risk.
User Accounts
Certain features of the Platform require registration. When creating an account, you agree to: (a) provide accurate, current, and complete information; (b) maintain and update that information to keep it accurate and complete; (c) maintain the security of your login credentials; and (d) accept all responsibility for activity that occurs under your account.
You must be at least 13 years old to create an account. Accounts created on behalf of persons under 13 are prohibited.
MapTurtle reserves the right to suspend or terminate any account at its sole discretion, including for violation of these Terms, suspected fraudulent activity, or inactivity for an extended period.
User-Generated Content
5.1 — Content You Submit
The Platform may allow you to create, upload, share, and publish content including trip itineraries, route descriptions, photos, reviews, event listings, and comments (“User Content”). You retain ownership of any intellectual property rights you hold in your User Content.
5.2 — License Grant to MapTurtle
By submitting User Content to the Platform, you grant MapTurtle a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, distribute, publicly display, and create derivative works from your User Content in connection with operating, promoting, and improving the Platform. This license continues even if you stop using the Platform, but you may delete your content at any time to revoke this license with respect to future uses.
5.3 — Your Representations
You represent and warrant that: (a) you own or have the necessary rights to submit the User Content and grant the license above; (b) your User Content does not infringe any third party’s intellectual property, privacy, or other rights; and (c) your User Content is accurate and does not contain false or misleading information, particularly with respect to aviation safety data.
5.4 — Shared Trips
When you use the trip-sharing feature, you acknowledge that any trip shared via a public link or QR code may be viewed by anyone who possesses that link. You are responsible for the privacy settings you select. MapTurtle is not liable for unintended disclosure resulting from your sharing choices.
5.5 — Content Moderation
MapTurtle reserves the right, but not the obligation, to review, edit, or remove any User Content at its sole discretion, without notice, for any reason including violation of these Terms or applicable law.
Intellectual Property
6.1 — MapTurtle's Proprietary Rights
The Platform, including all editorial content, curated Experience narratives, canonical place records, proprietary data schemas, the MapTurtle data layer, software, design, graphics, logos, and the “MapTurtle” name and brand (collectively, “MapTurtle IP”), are owned by MapTurtle or its licensors and are protected by copyright, trademark, trade secret, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use only. No other license is granted. You may not reproduce, distribute, create derivative works of, publicly display, or exploit any MapTurtle IP without prior written permission.
6.2 — Prohibited Data Uses
You may not scrape, crawl, index, bulk-download, or otherwise systematically extract data or content from the Platform. You may not use any automated tool to access the Platform without MapTurtle’s express written consent. Republication of MapTurtle’s curated editorial content, Experience narratives, or aggregated data in any form is strictly prohibited.
6.3 — Feedback
If you provide MapTurtle with feedback, suggestions, or ideas regarding the Platform, you grant MapTurtle an irrevocable, perpetual, royalty-free license to use that feedback for any purpose without any obligation to you.
Third-Party Data & Services
The Platform aggregates and presents data from third-party sources including, without limitation, OpenStreetMap contributors (licensed under the Open Database License), the U.S. Federal Aviation Administration (FAA), Foursquare Places, and official airport and FBO websites. MapTurtle provides attribution to these sources where required by applicable licenses.
MapTurtle does not warrant the accuracy, completeness, or timeliness of any third-party data. Third-party data is presented as received or processed and may not reflect current real-world conditions. MapTurtle is not responsible for errors or omissions in data originating from third-party sources.
The Platform may contain links to third-party websites. MapTurtle does not endorse, control, or assume any responsibility for such third-party sites or their content. Your use of any linked third-party site is subject to that site’s own terms and conditions.
Aviation Events
8.1 — Event Listings
Event coordinators and organizations may submit aviation events for listing on the Platform. By submitting an event, you represent that: (a) you are authorized to promote the event; (b) the information provided is accurate; and (c) the event complies with all applicable laws, regulations, and airspace authorizations.
8.2 — MapTurtle's Role
MapTurtle is a passive directory and does not organize, sponsor, endorse, or assume any responsibility for listed events. MapTurtle is not a party to any transaction between users and event organizers. You attend, organize, or participate in any listed event entirely at your own risk.
8.3 — Event Organizer Indemnification
If you list an event on the Platform, you agree to indemnify, defend, and hold MapTurtle harmless from any claims, damages, or losses arising from your event, including claims by attendees or third parties.
Prohibited Conduct
In connection with your use of the Platform, you agree not to:
- Post false, misleading, or inaccurate aviation safety information
- Impersonate any person, entity, FBO, or aviation authority
- Use the Platform for any unlawful purpose or in violation of any applicable regulation, including FAA regulations
- Scrape, crawl, or systematically collect Platform data without written authorization
- Reverse engineer, decompile, or disassemble any portion of the Platform
- Interfere with or disrupt the integrity, security, or performance of the Platform
- Post spam, unsolicited commercial messages, or irrelevant event listings
- Introduce viruses, malware, or other harmful code
- Harvest or collect other users' personal information without consent
- Use the Platform to compete with MapTurtle or to build a substantially similar service
- Violate the intellectual property or privacy rights of any person
Disclaimer of Warranties
THE PLATFORM AND ALL CONTENT, DATA, AND SERVICES THEREIN ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MAPTURTLE EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.
MapTurtle makes no warranty that: (a) the Platform will be uninterrupted, error-free, or secure; (b) any information on the Platform is accurate, current, or complete; (c) any defects or errors will be corrected; or (d) the Platform is free of viruses or other harmful components. Your use of the Platform is entirely at your own risk.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL MAPTURTLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, PERSONAL INJURY, PROPERTY DAMAGE, AIRCRAFT DAMAGE, OR DEATH, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE PLATFORM OR ANY CONTENT THEREON, EVEN IF MAPTURTLE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow the exclusion or limitation of certain damages, MapTurtle’s liability shall be limited to the greatest extent permitted by law. In no event shall MapTurtle’s aggregate liability to you for all claims arising out of or related to the Platform exceed the greater of (a) the total fees paid by you to MapTurtle in the twelve (12) months preceding the claim, or (b) one hundred U.S. dollars ($100).
The limitations in this section apply regardless of the legal theory (contract, tort, strict liability, or otherwise) and whether or not MapTurtle has been informed of the possibility of such loss or damage.
Indemnification
You agree to indemnify, defend, and hold harmless MapTurtle and its officers, directors, employees, agents, affiliates, partners, and licensors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys’ fees) arising out of or relating to:
- Your violation of these Terms
- Your User Content, including any claim that your content infringes a third party's rights
- Your use of the Platform in a manner that violates applicable law or regulation
- Any aviation incident, accident, or damage arising from your reliance on Platform data
- Any event you list on the Platform
- Any dispute between you and another user or third party
Termination
MapTurtle may, in its sole discretion and without prior notice, suspend or terminate your access to all or part of the Platform for any reason, including violation of these Terms. Upon termination, your right to use the Platform immediately ceases.
You may terminate your account at any time by contacting us at the address below. Termination does not affect MapTurtle’s license to User Content you have previously submitted, except as described in Section 5.2.
Sections 3, 5.2, 6, 10, 11, 12, and 14 shall survive any termination of these Terms.
Governing Law & Disputes
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You consent to the exclusive jurisdiction of the state and federal courts located in Contra Costa County, California for any dispute arising out of or related to these Terms or the Platform.
Informal Resolution. Before initiating any legal proceeding, you agree to first contact MapTurtle and attempt to resolve the dispute informally for a period of thirty (30) days.
Class Action Waiver. To the fullest extent permitted by law, you waive any right to bring claims against MapTurtle on a class action or consolidated basis. All claims must be brought in your individual capacity.
Jury Trial Waiver. To the fullest extent permitted by law, both parties waive any right to a jury trial in connection with any dispute arising under these Terms.
Changes to Terms
MapTurtle reserves the right to modify these Terms at any time. When we make material changes, we will provide notice by updating the “Effective Date” at the top of this page and, where appropriate, by notifying you via email or a prominent notice on the Platform.
Your continued use of the Platform after any change becomes effective constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Platform.
